Asking for a junior member in my squadron

If a member has no physical or legal custody of their child are they entitled to single rate or dependent rate BAH.

One of my guys got divorced and PCSd and ex wife and kid are 2000mi away. He gave up rights in exchange for ex wife not reporting domestic violence to CoC or FAP. He gets supervised visitation but has to travel to the kid.

    BAH

The driving factor for BAH is his page 2. If his child is listed as his dependant there, then he is entitled to dependant BAH.

    2. If he lives in the barracks and pays child support, he would get BAH-DIFF. Child Support must be at least equal to the BAH-DIFF rate.

If he is approved to be out of the barracks and pays child support, he gets BAH with dependents.

See DoD FMR, Volume 7a, Chapter 26.
