Has anyone utilized the SCRA to break a lease with orders that are in the same area (Alameda to YBI)? I’ve looked pretty much everywhere and can’t find anything saying it has to be a certain distance. We are in a rental that was not as advertised and would love to get out ASAP.

      IANAL, however, without seeing your specific lease it’s hard to answer; from my personal experience (not California), my lease typically mentions a minimum distance for PCS to qualify (35 miles). From my limited research, California SCRA law may not do this and you may be in the clear legally speaking.

      If you can get orders for a pcs it should work. There isn’t any distance requirement- I think they just assumed you wouldn’t get pcs orders if you were that close.

    3. As long as they are PCS orders, SCRA allows you to break your lease. If they are PCA orders, SCRA won’t apply.
