I started mil leave at my civilian employer in 2022 for USAF tech school for my guard unit. That schooling will run until this coming fall, at which point I will come off orders and be a traditional DSG.

My guard unit is in a different state than my civilian employer. While I worked remote/hybrid for my employer prior to starting tech school, they have since gone 100% on site. As a result, I am trying to get a remote work arrangement in lieu of having to go into the office, as I no longer live near my civilian employer.

Does USERRA offer any protections for me where my employer would have to take me back on a remote basis? I know it offers a lot of employee/service member protections, but I'm not great with some of the legalese that goes into interpreting the law and how it might apply to my specific situation.

    1. Nope. You will have to go in person if you want to keep your job. USERRA does nothing here.
