Hello all,

    I recently got rear ended in a yield merge lane and was wondering how to go about this.

    For some context:

    I am driving in a merge lane on the right side, passing the yield sign and notice around the curve that there is a guy in a car parked halfway on the curb, essentially obstructing the lane. I stop for a second because there is no way to physically go through the car and I am waiting to try and merge into the left lane.

    The car behind me does not stop and ends up rear ending my car.

    I have everything on dash cam (front and back)

    Becuase it was a yield sign and there was a car blocking in the front, I am sure that I am not at fault legally.

    However, aside from the car who rear ended me, would the car who parked on the curb also be at fault? He did not have hazard lights on.

    Rear ended in a merge lane, what is the best way to go about this ?

      The car on the curb most likely wouldn’t be responsible for any part of your claim.

    2. Even with no hazards, he not responsible. You did the right thing by stopping. The other did not.

      My advice is to learn how your vehicle will be repaired and don’t leave the body shop until you’ve measured the paint with a meter, checked the gaps and looked for any inconsistencies in the texture of the paint. Check all the door jams as well to make sure the vehicle was painted correctly.
