Rush hour, dog ran out in front of the car ahead of me, they slammed breaks and I crashed into them (with my kid in the backseat and almost being piled up upon, thankfully everyone else dodged us).
    She gave me her information and left super fast, said she couldn’t stay but also said a bunch of times she couldn’t pay for this. I feel bad, because it was a dogs fault. She said she has liability insurance but I didn’t get the name of it, just her number and driver’s license.

    Should I file a claim for this? The front corner of my car got hit good. How do I go about this? I have not filed a police report because I haven’t decided what I should do.
    My car was totaled because of hail a year ago. Still a fine car.
    Will the insurance charge the lady at all? Make hers go up? Surely they can’t blame her for a dog?

      If so, how is this anyone’s fault but yours?

      You rear ended them, you’re at fault. You have duty to maintain safe following distance that will allow you to stop in time and the dog running out in front of her is also not her fault. This is going to be an at fault accident through your own carrier.
