So my partner was rear ended in my car. Person lied to police and confirmed later that they didn't have insurance. I have UM coverage and filed a claim bc we were having trouble getting an estimate without one. My partner still has neck pain and headaches. The kicker is this person is a workers comp lawyer with a successful practice. They admitted fault and offered to cover costs. Called me today and said they found blue book value of my car to be $16k and said they do well for themselves and would like to make an offer. Looked them up and it's obvious they do. Was driving an Audi sports car and following too close in rush hour traffic. State farm is taking a really long time to set us up with a rental and garage and they say it's our state and my vehicle is undrivable unless I come out of pocket to replace a whole wheel which I don't want to do.

    Clearly I don't trust this person bc they already lied and bc they're a lawyer (no shade to lawyers lol), but if they're offering cash and has assets, what would I be losing out on by taking the offer? Can I have insurance cover the cost of repair and rental and go after them civilly? I'd prefer insurance but want them to have consequences and my partner to be compensated for what they had to go through.

    At fault uninsured motorist wants to cover all costs?

      Did they just say they are a lawyer or are they actually? Because I didn’t know a single insurance or workers comp lawyer that would be stupid enough to drive without insurance.

      Within 3 months of me starting working for an insurance lawyer, I got comprehensive, collision, and upped all my coverage past state minimums, because I quickly saw how stupid and tragic anything else is.

      If someone is giving you verbal agreement they will pay cash, that’s a huge red flag. Immediately contact your insurance, and let them subrogate at their discretion. It’s so easy to get ripped off by the too good to be true “I’ll pay cash” verbal agreement.

      And to reiterate, if this is actually a lawyer that deals with insurance whether standard or workman comp and they don’t have auto insurance, they are a dipshit. They are very familiar with the concept of liability and damages, whether bodily or properly, and they know better. Let them suffer the consequences.

    2. UIM coverage won’t come into play if he was uninsured. UM coverage will.
