Hey Everyone,

I am active-duty and will be leaving my first command with PCS orders to attend C-School. I will arrive at the end of this month and graduate in December where I will move on with a new set of orders. I am married and have been told that my ACC code on my orders allows me to live off base and bring my family with me. The location I want to lease offers a 6mo and a 12mo lease. The 6mo lease is around $250 more than the 12mo lease. Should I apply for the 12mo lease to save the $250 a month knowing I will be leaving in ~6mos? There is a possibility that I stay in this location for my next set of orders, but it is rare to happen. I want to avoid any legal or financial issues that could occur by doing this.

Any advice would be greatly helpful!

12 month or 6 month Lease on 6 month Orders?

    1. Depends on the lease. Gotta check and see if it has a military clause that allows you to exit the lease agreement early if you are given orders.

Edit: I was actually confused myself. Read the other replies regarding SCRA.

    2. Do you actually have your orders to leave your C school location? If not, you can sign the 12 month lease. SCRA allows you to break a lease anytime you sign a lease and then get PCS orders *after* signing the lease.

The main risk with that is the SCRA doesn’t get you out of your lease immediately. Once you give proper notice including your orders (or other verification from your CO), you are on the hook for rent for 30 days after the next time rent is due.) That’s fine if you get orders a couple months before the end of school. If you get orders very last minute, you could end up paying a month being when you actually move out.
