I just got served for a lawsuit against me by someone I rear-ended two years ago. The damage on his car was minimal and no damage on mine. After the accident the guy said he was fine. He filed a claim with my insurance and I assume they paid him, but he is now saying he is unable to work and evidently needs more money.

    Then long story is that before I rear-ended this man, he rear-ended another car which had much more damage. The other two cars were driven by undocumented persons from Mexico which seems like quite the coincidence.

    I’m terrified that I am going to lose everything I’ve worked for. Advice?

    1. Has your insurance company paid your policy limits? Ask your agent. My agency is open and honest as to telling our clients payout amounts. I assume others are as well. If the limits are exhausted, they no longer have to defend you. If they haven’t paid the policy limit, get that summons to them ASAP and they have the choice of paying, defending or a combo of both, at their expense.
