Title basically sums it up. I was in an accident that was the other party’s fault but chose to file a claim through my own insurance for various reasons. I do not have rental car coverage because I have two cars so I didn’t expect to need it. Turns out I did have to rent a car and spent a significant amount out of pocket. I know my insurance will try to recover my deductible through subrogation, but can they also attempt to recover my out of pocket rental car expenses even though I don’t have coverage for that? If I had filed through the opposing party’s insurance they would have covered the rental car, so I feel it is a reasonable ask.

    Can I seek subrogation reimbursement for rental car expenses if I don’t have rental car coverage?

      No they can’t subro for rental for you since they didnt pay for a rental on your behalf. They can only go after the other party for what they paid out. You’ll have to submit a claim to the other party’s insurance for the rental coverage yourself.

      Your insurance company can send the bill and proof of payment over as a courtesy, but they can’t negotiate with the other insurance company or anything.

      You can also submit this to the other carrier yourself and ask for reimbursement.

    3. You can contact the other party’s insurance and provide the proof of payment for loss of use yourself. It’s lots more useful than sending the bill to your insurance’s adjuster because the other carrier may have questions about why you didn’t go thru them instead, why your rental took a certain amount of time, etc.
