Hello all,

    Almost 2 months ago, I was involved in an accident where I was at fault. I rear ended a vehicle that was stopped in a 55mph zone in the right lane. I was uninjured (thank God) and the other driver did not request or need immediate medical assistance. Police showed up, took our info, and waited for the tow truck. I never went over to the other car, as it was cold and rainy and the police came rather quickly. Also, someone who was not involved in the accident checked on both vehicles to make sure everyone was ok. Once the tow truck came for my car (it was totaled) I rode with him and left the scene.

    About a week later, I received a letter from a law firm that said they were representing the driver of the other vehicle. I forwarded it to my insurance company (USAA) and gave the law firm the info they requested in the letter.

    Another 2 weeks go by, and I receive an additional letter from the law firm, saying they represent a second person in the other vehicle. I never remembered seeing a second person in the other car, but I figured it was legit.

    Fast forward to today (a month after the second letter) USAA calls me and asks if I know how many people were in the other vehicle, and replied that I wasn't sure. I did have a copy of the information exchange form, and the adjuster was able to get a copy of the police report, stating that there was only 1 person in the other vehicle. The adjuster told me this isn't uncommon for "Jump Ins" trying to commit insurance fraud.

    So who is lying here? Clearly the second person, but would the law firm try to file a claim knowing this is fraud? What recourse does USAA have in matters like this? Has anyone had this situation happen to them and what was the outcome?

    I 100% am fine with the other driver getting whatever is owed to him, it just amazes me that people are this shitty.

    1. This will go right to their SIU department for handling due to the probable fraud and they will address it with the attorney.

    2. I saw a city bus that had broken down on the side of the road. It had been there for over a hour when a car ran into the back. By the time police got there there were at least 15 people on the bus claiming injury and 5 people in the car.

      There was nobody on the bus and only one in the car. The bus driver was not even on the bus.
