I recently got into an accident and was hit by a hertz renter where he was at fault. I only have liability so I can’t go for my insurance, a hertz adjuster came and checked out the car and gave an estimate of $7000 in damages. Sent the car to an auto-shop and they claim it’s totaled. What are the chances Hertz will pay me money for the totaled car beyond the renters limits, which I believe is $10,000. Need some advice.

      We can’t comment on this without seeing what kind of coverage is in place for Hertz and/or the driver, and whether or not the renter purchased the additional coverage from Hertz for liability. (property damage)

    2. 1. You need to know if the renter purchased the Hertz waiver for liability of collision damage. If they have, you’re stuck with the limits of what the renter paid. If they haven’t, you can file thru the renter of the Hertz vehicle’s insurance but their limits are the most you can file for.

      2. Limits are limits. If the total loss is up to $10,000, that’s all you have coverage for.

      3. Confirm with your insurance that you only have liability coverage. Some states require that you decline uninsured and underinsured motorist coverages.

      The other drivers insurance should cover your damage. Hertz really doesn’t have anything to do with that. Put it through the other guys insurance

      What state are you in/did the accident occur in?

      1. You will need Hertz to confirm their limits provided by the Rental Agreement, most provide state-minimum on a primary basis with an option to add more via a supplemental liability coverage. If the supplemental was denied, then you’d get state-minimum.

      2. If you believe your vehicle is more than state-minimum, contact the other driver to see if they have auto insurance that could step in for excess.

      Hertz will not pay more than they are legally required to.
