While driving a Rent-a-Car, a speeding out-of-control SUV hit me when he tried to pass me in the gravel median. 911 was called, and police arrived and filled out some forms. The very polite police officer told me the driver of the other car did not have insurance or a driver's license and was at fault. I contacted my insurance company and submitted a claim for the damage. I also contacted Hertz and submitted paperwork regarding the auto accident. The rental car was towed to a Hertz Garage. And I got a new car rental.

    What will happen now? I have never had an accident with a car rental. Neither Hertz nor my insurance agent gave me much information. The accident was in New York State so it happened in a no-fault auto insurance state. But the other party was at fault.

    There were no injuries and the car that hit us did not show any damage. The only damage was our car which was a Hertz Car Rental.

    The credit card (American Express) I used for my auto rental has insurance coverage, but it is secondary. Should I still submit a claim with American Express hoping that insurance will cover my deductible, or other costs not paid by my primary insurance?

    1. I’d presume that it pays whatever your own insurance does not if it’s secondary, but it depends on what the card agreement actually says.

      New York is a bit weird because (IIRC) damage to rental cars is covered under your *liability* coverage instead of your collision/comp the way it is in most states. Personal auto liability doesn’t normally have a deductible. Only collision and comp do.
