I had a shoulder bone contusion and they want to pay for my 4k in medical bills + 6k in general damages for a total of 10k. I got some physical therapy and other doctors visits. Is this a fair settlement in Florida?

      Are you done treating? That’s the first question I’d ask yourself before settlement.

    2. None of us can decide whether you think it’s a reasonable payment for your suffering. And it’s not $10K – they owe the $4K in medical payments no matter what else they may owe (assuming their driver is at fault). The medical bills are real costs, and that money doesn’t end up in your pocket – it goes to the medical facilities, doctors, etc. So the question is – would you accept $6K to go through the ordeal you’ve gone through? A bone bruise hurts for sure, but it sounds like you’re healing up and won’t have any lingering issues. So do you think $6K for the suffering you incurred is more or less “right”?

    3. Also consider lost time from work, and any other expenses incurred as a direct result both now and in the future. There’s always the potential for something medically related to flare up in the future that isn’t immediately apparent right now. I’d consult an injury attorney in your state for their assessment. I don’t think you’re going to get the optimal advice here.

    4. If I’ve learned anything from a lifetime of watching television, it’s that you should start wearing a neck brace and take them to court immediately. 

    5. Do you know what the driver’s liability limit was? Or are you using your own policy? It may be that $10K is all there is.

      I’m shocked the other driver even has BI coverage since it’s not required in FL. I’ve rarely seen higher than 10/20 BI limits. That’s probably all you’re going to get.
