Hi everyone, my Tesla Model Y (Grey) was dinged by a red sedan. I had parked my Model Y right outside of Panera to grab coffee. While grabbing coffee, my wife was in the car when she heard a "popping"-like noise from her left and felt the vehicle shake a bit. She saw that the driver of a red sedan to our left (drivers side) had opened the door of her vehicle too hard and had hit the drivers side passenger door of our Model Y. After inspecting our Model Y together, my wife and I found a noticeable ding with red paint still on the ding, left by the red sedan's door. We also saw that on the drivers door of the red sedan, there is also peeling of paint exactly on the point of impact with our Model Y, exactly where the ding had happened—this peeling of red paint has transferred over to the ding on our Model Y. The red sedan driver and we verified, by slowly opening the red sedan door to the point of contact with the Model Y, that the angle and area of impact exactly match the ding on our Model Y and the peeling of paint on the red sedan drivers door. The sedan driver keeps stating that she "only barely touched our Model Y when opening her sedan door" and that "the wind blew the door open, which caused it to hit our model Y".

    When we slowly opened the red car's door together to verify whether it was actually her door that made the ding, the point of impact was maybe about 1/2 cm above the ding. Then she claimed, "see! I'm not the one who made the impact". But I believe that the point of impact was 1/2 cm above the ding when we slowly opened the red car's door because she wasn't physically in the car (which would have caused the car to "sink" a bit lower due to her weight as she looked quite heavy).

    Unfortunately, since my wife was in the car, my Tesla's sentry did not save the video clip of her actually opening her door. I was able to retrieve bits and pieces of videos that show that her door is physically touching my door.

    I have opened a claim with my Tesla insurance. The total cost to fix the ding (and also the dent) is going to be $1800 ish. I will have to pay $1000 deductible and Tesla insurance will pay $800. Tesla insurance told me that after I get my car fixed, they will pursue the other person's insurance to get the entire $1800 back.

    Question: Is my evidence enough to determine that she (the red sedan's driver) is the one at fault? After my car is fixed and after I have paid the $1000 deductible, I don't want to be told by her insurance that the evidence is not enough and that I'm unfortunately not gonna get my $1000 back.
