Hi y’all. Please shed light on this scenario. There’s a service member who recently got stationed OCONUS unaccompanied, he was receiving BAH prior being stationed there.

    He’s married, no children and lives in the barracks. He’s undergoing divorce with his wife, they agreed verbally and in papers that they will not meddle with each others business/life/money while undergoing divorce and after. They are no longer in contact excpt if it’s about divorce/thru their lawyers.

    Finance stopped his BAH because he cannot produce a lease/mortgage. He explained his situation but still said he is not eligible, that he is forced to support his dependent-wife. It is for his wife and not his. Is he still entitled to BAH?

    1. Given that it is an unaccompanied OCONUS assignment, they should be receiving BAH with dependents until the divorce is finalized.

      My service (USCG) requires a specific BAH rate protection form with the address and BAH zip code be approved through finance and on record before BAH can be paid though.

      BAH doesn’t change until the divorce is finalized. He is still entitled to it for his wife until the divorce is finalized since it’s an unaccompanied OCONUS tour.
      That said, OHA requires a lease, they may be conflating the two
