Recently divorced and retired. My divorce decree doesn't stipulate anything regarding continuance of SBP, however, my attorney drafted a QDRO which includes the SBP and the court approved it. I'm finding this out after the fact. I believe he made a mistake, but he maintains SBP is marital property. I think he is wrong and have shown him research to validate my point. He finally gave into me and will submit an amended QDRO to the court to have the SBP removed. Anyone else have experience in this area?
