Title kinda says it all. Car would easily be totalled under comprehensive auto insurance… I am familar with that process but this car only has liability…. so I am praying there is a way to get their homeowners insurance to help. Super stressful…. Car still drives fine from what I can tell., kinda surprising the top didnt buckle in more but it's very totalled. Thoughts? In Wa state if that makes any difference…. that wind and thunder was pretty nuts.

Tree fell on my car while parked at a friends place…. they own the house and have home owners insurance.

    1. Do you have reason to believe that the homeowner was negligent to make them liable for the damage?

If you don’t have comp then it’s not covered. For your friends insurance to cover it you would have to prove negligence or that they knew the tree was a hazard and didn’t do anything

Tree law and premises liability typically removes responsibility from homeowners if a tree falls during a storm due to it being considered an “Act of God”. Unless you can prove your friend failed to maintain the tree properly and knew it was a hazard, you are likely out of luck. This is why comprehensive coverage is extremely important. For a couple hundred bucks more a year, you can save thousands.
