My vehicle was damaged from rocks falling off the trailer of a landscaping/tree company while driving on the highway. I followed the truck until the driver stopped and showed him the damages. Cracked windshield and many rock chips in the paint.
    He told me "insurance, no problem, insurance no problem" and gave me his information. I submitted all my evidence (dashcam footage, pictures, text messages, and a witness statement from a lady who's car was also damaged)

    His insurance company came back and said that his policy doesn't cover business use and they're denying the claim. He got mad at me and said that it’s my fault his insurance won’t cover it because i told them he was using a trailer. he told me I need to call them back and change my story, I didn't do that but I did go get a quote. It was expensive and he didn't like that quote, tried to get me to go to his buddies shop but i was like fck that so l went to a different shop. He also didn't like that quote so I went to a third shop. He finally agreed to pay but in payments of $500.

    The first payment became due and he didn't pay. I told him I'll have to take him to court and he blocked me. I contacted my insurance company and they told me I would pay my deductible, the car would get repaired and they would go after him/his insurance for the damages, however I was told by a friend that if they can't recover the cost from him that my insurance rates will skyrocket. I already pay, in my opinion, too much.

    What should i do? file a claim under my policy? try to take him to court? I've very disappointed, I just paid $2,700 in February of this year for the front end of my car to be repainted due to rock chips accumulated over time…

    Hoping for a few more opinions on this before I make a move…
