We recently bought a new car, and while it was parked on the street, a pickup truck hit it from the rear, severely damaging the back end. The car is now undrivable. We called the police, and we have the police report.

It’s been over two weeks, and we still haven’t been compensated. The truck’s insurance company, Trexis, said they would send an inspection team, but it seems they’re using a third party for this, and we haven’t heard anything since. Every time I try to contact them, they either don’t pick up or keep us on hold, which is incredibly frustrating.

It’s been really challenging to manage daily activities without a car. When I finally reached them yesterday, they mentioned that they can’t provide a rental car until we are insured because the claim hasn’t been verified yet. They said they can’t reach the person under whose name the insurance is registered, and it feels like they might be trying to avoid compensating us. The truck driver wasn’t the owner of the vehicle.

I’m new to the US and not familiar with how these processes work. This was my first car, and I feel really bad. Some people have suggested filing a lawsuit, but I’m unsure about how to proceed. Any advice on what I should do next would be greatly appreciated.

It seems easier to use your collision coverage to repair your car and have your insurance company work this out later.
