Drove through a stop sign at a four way stop going southbound. Totally missed stop sign and the car going west bound went at the proper time and ended up hitting the rear of my vehicle on the right. I flew off the road and into a ditch, unable to stop, but got myself out of it and back on track. At that point they drove away so I just kept driving.

    I’m the one who ran the sign so I feel like I am at fault here but legally they are the one who hit the side of my vehicle. What I’m wondering is— my vehicle has minor damage that I’m not going to try to get fixed or contact insurance about. Slight crumple around my tire but the bulk of it looks like it will buff out. What do I do about them? Should I expect to hear something via the mail?

    1. Yes. You ran a stop sign

      They wouldn’t have hit you if you hadn’t run the stop sign in the first place

    2. A crumple around the tire can mean hidden expensive damage and stuff rubbing on the tire

    3. Yes, you’re at fault because you didn’t obey the stop sign. (If your state assigns fault by percentage, the other driver may have some liability because they didn’t verify the intersection was clear before they entered. But I wouldn’t count on it.)

      I suspect they either don’t have damage or don’t have insurance. If you don’t want to admit fault, don’t file a claim and pay for repairs out of pocket. 

      Document your perspective of the accident (time of day, witnesses, etc.) and keep it handy if they are able to track you down.

      I’m over here trying to figure out how its even possible get T boned but have “minor damage” with both cars driving away.

    5. You got lucky. Keep your mouth shut, but if contacted own up to it. Other driver either has no license, no insurance, no registration, had warrants, was impaired, etc. Very common for drivers like that to take off. They wanted to avoid the police for whatever reason.
