I got into a minor accident earlier this week where someone side-swept my car, leaving a scratch on her car and a dent/scratches on mine. my repair will cost around $500 and I’m certain hers will cost less. because my deductible is $2000, I think it would make the most sense for me not to file a claim and just pay for the repair myself.

    the only issue is that she claims it was my fault (which it wasn’t) and she filed a claim against me. I’m worried that if I don’t file a claim and pay for my repair out of pocket, her insurance company will come after me and make me pay for her repair. she also claims that her back hurts 2 days later, so I definitely don’t want to get hit up for any medical bills (even though she’s trying to commit insurance fraud and probably won’t be able to convince her insurance co that she’s injured).

    I’m not sure what the best course of action is here. any advice?

    Should I file a claim or pay out of pocket?
