Posting this for my dad – While on vacation in Florida, I was hit by a car while riding my bicycle on a designated bike path. As I am a tourist, I do not have insurance in the US. The car did not stop at a stop sign and hit me as the bike path was crossing a small road. I had no stop sign on my side, and the sign in the intersection clearly states that the “trail does not stop.” There is video footage of the accident and the police report confirms I was not at fault and that the driver broke the law by not stopping at the stop sign and crosswalk. The driver admitted that he was responsible, and there was a witness. I was unconscious after being hit and was rushed to the hospital by ambulance for head trauma and had to get several CAT scans, xrays, 28 stitches in my head, etc. I also had to undergo several physical therapy sessions after the fact. I contacted the driver's insurance company (State Farm) to file a claim. The driver of the car had already reported the accident to the insurance company and admitted fault. The insurance company confirmed that I am not liable. They assured me they would cover all the medical bills.

    However, yesterday, when I tried to contact my agent, an unidentified woman answered the phone and rudely informed me that State Farm wouldn’t pay anything because I don’t qualify for PIP and Florida is a no fault state. As I do not live in the U.S. I don’t really understand what this means. She then said we would have to contact my daughter’s insurance for them to cover it. We told her multiple times that my daughter is not involved with this accident at all and we believe there may have been some confusion because we put my daughter’s address on the claim as we do not have a U.S. address. I explained to her that I was already in contact with an agent who confirmed they would cover the medical bills, and I repeatedly asked to speak with him, but she refused to listen to anything I was explaining and kept insisting that I did not qualify for PIP and they were not responsible for any of my bodily injuries or medical bills. She also refused to let us speak with her supervisor.

    Meanwhile, my daughter, using another phone, was able to reach our agent, who confirmed that they have all the hospital bills and that they would cover everything as they fall into “bodily injuries.” He said that there must have been some confusion with everything related to PIP.

    At this point, I’m starting to have some doubts. Who and what should I believe? Does anyone know what the woman was talking about regarding PIP? As I am not a US citizen, I don’t know how this all works. Should I get a lawyer? Ideally I do not want to sue and would prefer to handle this quickly.

    1. If you’re on vacation internationally surely you have travel insurance. File a claim with them and let them subrogate
