A couple of weeks ago, my car was hit in a parking lot. I was already parked, opened my door to get out, and the other driver drove straight into the edge of my door while I was putting my sunglasses away. We exchanged insurance information, but I could tell the other driver was going to be difficult as she kept saying “you need to look before getting out, this is not my fault.”

    Anyway, I contacted my insurance company, an adjuster came to look at my car and they made a determination that I was 0% at fault and the other driver was 100%. Now an investigator from her insurance company is calling me wanting a statement for their investigation. I feel bad about not calling them back but also like it won’t help me to talk to them. Am I being paranoid, should I talk to their investigator?

    Talk to the other party’s insurance investigator?

      Are you getting the vehicle repaired through your own insurance or through theirs?

      I personally don’t like doing their recorded statements, specifically when everything is so cut and dry. If you are going to do it, some insurance companies allow you to do it in writing, meaning they send you the questions you answer them and send them back.

    2. You don’t have to talk to them if you don’t want to. If you don’t talk to them they’re going to base their assessment of fault solely on their insured’s statement without your side. Your choice.

      It costs you nothing to just give the same statement and they’ll likely assign fault the same way. Ultimately, if the insurance companies disagree, they’ll just arbitrate and go from there.

    4. You’re not going to like this but I agree with the other driver. From her point of view you opened your car door suddenly and she had no chance to stop. By your own admission you were paying attention to your sunglasses and not paying attention to your car door.

      Your adjuster may change his tune as this plays out.
