I am a florida resident stationed in Beale AFB and have been paying state taxes to Florida.
    I recently got married and she is a California resident. So I am wondering how can I keep my florida residency while I am living in California and married to a california resident. I plan to go to school in Florida after my contract and do not want to lose my status.

    1. Your residency/state tax will not change based upon your marriage as long as the only reason you are in CA is because of military service.

      Florida is your “home of record” your entire career, unless you change it for whatever reason. You and your spouse can file jointly in your home of record. Your spouse can also claim your home of record as their legal residence as well (even without living there).

      My husband’s home of record is Maine. Mine is too but I didn’t use the Military Spouse Relief Act. I was a resident of Maine when we met. Our driver licenses are in Maine, we vote in ME, we file our state income tax in Maine.
