In 2022 there was a hail storm that did a small amount of damage to the house I owned with my ex spouse. I repaired the damage myself, and there was no need to make a claim. In 2023 we divorced and my ex got the house. Shortly after our divorce was finalized my ex made a claim for the hail damage from the 2022 storm.

    At that time I contacted our agent and told him my ex’s claim was fraudulent and I wanted to withdraw it. He told me there was nothing I could do to stop them from making a claim on the policy because they were a named insured on the policy too. My ex later received a check from the insurance company with my name on it and deposited it themself and used the money to get a whole new roof.

    Later in 2023, because of this claim, I was only able to get insurance on my new house if hail damage was excluded. Now in 2024 my current insurer is refusing to renew and other insurance companies are denying coverage citing this claim as the reason.

    I have never made a claim on any of my home or auto policies in 20+ years of owning cars and houses. My ex’s claim is the only blemish on my record, and is being cited as the reason for denial of coverage.

    What options might I have now? Is there a way to get my ex’s claim removed from my record? How can I get insurance on my house if all the insurance companies are denying coverage due to this claim?

    1. You probably need to talk with an insurance attorney. It it quite likely it will be unfixable because two people on the same non fraudulently obtained policy can usually legally be considered a unit as far as insurance claims reporting is concerned. You will likely end up having to work with an agent to find alternatives and you will probably get hosed on pricing for a certain amount of time until it burns off.

      You’re screwed. Probably you’re going to have to accept whatever exclusions somebody demands to insure it. Find an insurance agent who is willing to place a tough risk and consult with them on what makes the most sense for you. The last fallback will be the FAIR plan, which will have terrible terms at ludicrous prices, but will take you guaranteed.
