The claims adjuster and I differ in how much I should be paid for pain and suffering and also he does not want to pay me for me using my PTO/Vacation hours that I used to recover from my injury. Where do I go from here, what are my options?

What do I do if the claims adjuster and I are not coming to an agreement in the amount I should be paid for my car accident claim?

    1. Realistically you either get an attorney and hope they’ll do a better job at handling your claim than you, or you accept what is taken. They’ll take 30-50% of your claim so this probably isn’t a good idea.

The insurer hold the pocket book and so they make the final decision.

Did you see any medical treatment? Is there any professional medical documentation stating you needed to take off those hours off work?

    2. How are you documenting what you are claiming? Did a doctor advise you to take time off work? They’re not going to accept that time off is medically necessary if it’s not documented. Your currency in this negotiation is documentation to support your claim.

    3. You fail to give necessary information.

You want people to take a side on things like pain and suffering and recovery time but you dont give any detail.
