Was hit by an uninsured and unlicensed motorist in CA. Vehicle is on the older side, but mechanically and functionally sound, with an estimated value of around $5K (>10 years and >150,000 miles. Issue is, most likely, if an insurance claim is made for uninsured motorist I would have to pay a $1K deductible(no UIM deductible waiver).

    1) I don’t want to total out the vehicle (not trying to buy back the vehicle with salvaged title)

    2) Realistically, I could probably get the vehicle back to 70-80% condition for less than $1000 as it was mostly paint transfer and two dents that look like they can be pulled out via paint less dent repair.

    3) Even with insurance, probably would be next to impossible to get my $1000 back with subrogation.

    Questions:
    1) Do I need to file a police report and SR-1 DMV form?

    2) If I were to fix my vehicle myself, how could I prevent the other driver from claiming I was at fault later on.

    1. 1. Not an insurance question but a DMV question. But you need to follow whatever requirements the DMV has. 

      2. You can’t prevent that. If they do come after you, you’ll can try to defend yourself in court if they actually sue you (highly unlikely they’ll do that) or open a claim and let your insurance defend you. 

    2. You need to file a SR-1 when property damage is over $1K or anyone was injured (no matter how minor).
