    The Division of Oil, Gas and Mining will conduct a Briefing Session at 9:00 a.m.:

    The Board will hear the following Matters at 10:00 a.m.:
    1. Docket No. 2017-013 Cause No RO&G-2017-01 – In the matter of informal rule making associated with the 2017 and 2018 legislative amendments concerning forced pooling and the need to initiate rulemaking on other emerging matters, including but not limited to, rulemaking on operatorship designation.

    At this public meeting, the Board of Oil, Gas & Mining (“BOGM”) will be focusing exclusively on proposed rules addressing the 2017 and 2018 legislative amendments concerning compulsory pooling. The proposed rules have been circulated to all interested parties in advance of the public meeting. This is the final public meeting addressing the proposed rules before initiation of formal rulemaking.

    The procedure for this public meeting will be as follows:

    a) Presentment of the proposed rules by the Division of Oil, Gas & Mining (“Division”) and identification of any material differences of opinion that remain, including the Division’s position regarding the issue(s) specified;

    b) A designated representative of the Utah Petroleum Association’s response to any remaining issue(s) with the proposed rules as identified by the Division, and presentment of suggested alternate language, if any; and Board Agenda for April 24, 2019

    c) A directed public comment period. The BOGM will receive public comment that is specifically directed to suggested revisions pertaining to the draft rules circulated in advance of the public meeting. The public and/or any other interested parties are encouraged to provide specific alternate language and/or proposed written revisions to the draft rules circulated in advance of the public meeting. If there is a proposed rule or issue not addressed by the circulated draft rules, in addition to any verbal testimony, a proposed alternate and/or newly proposed rule must be submitted in written form.

    The purpose of this procedure is to have directed public discussions in order to assist the BOGM in effectively and efficiently addressing any remaining concerns over the proposed compulsory pooling rules before the formal rulemaking process.

    2. Docket No. 2019-012 Cause No. S/049/0050 – In the matter of the Notice of Agency Action for reclamation at the Elite Rock-West mine, permit no. S/049/050, operated by Wasatch Mountain Excavating, located southwest of Elberta in the southwestern Utah County, Utah.

    3. Docket No. 2019-013 Cause No. 139-164 – In the matter of the Request for Agency Action of CRESCENT POINT ENERGY U.S. CORP. for an order force pooling the interests of all owners refusing to agree to lease their interests or otherwise bear their proportionate share of the costs of drilling operations for the Winterton #13-20-17-2-1W-H1 Well and the Winterton #14-20-17-2-1W-H1 Well in the drilling unit established by the Board’s order in Cause No. 139-154, comprising Section 17 and Section 20, Township 2 South, Range 1 West, U.S.M., among other lands, within the Randlett area, Duchesne County, Utah, for the production of oil and gas from the Lower Green River and Wasatch Formations.
