TYIA, I work in Illinois and my wife is stationed in Colorado. (I fly back and forth). I am a nonresident spouse of a servicemember, same domicile, and elect to have the same as my wife. I get it says you are accompanying the spouse in ILLINOIS; however, the "or" makes me believe it is optional and I can go with the last bullet specifically for taxation only. Am I interpreting this correctly?

    I need nonresident AND i have the same domicile as spouse or for the purposes of taxation and you are in Illinois, even if your service member spouse is not located in Illinois. Really hoping someone else has similar experience.

    • you are a nonresident spouse of a service member, and
    • you and your service member spouse have the same domicile and you are in Illinois only to accompany your spouse on his or her military assignment, or
    • you elect to use the same domicile as your service member spouse for the purposes of taxation and you are in Illinois, even if your service member spouse is not located in Illinois
