I got into a car accident a month ago. I’m getting my car back from the body shop this week of 5/27/24. The lady who hit my vehicle pulled out into my lane when I was past her car and scratched it from my passenger door back to the bumper in front of my tire. I got a letter from her insurance today 5/25 claiming she is not at fault and they will not be taking fault. However I know I am not at fault and my insurance has not decided yet. Does the other persons insurance say this typically that they are not at fault even if your insurance determines you’re not at fault and will they probably end up going to court? Please help I’m worried. Even though I know I’m not at fault the mail I received from the other insureds insurance stresses me out.

    Help me I’m confused about a car accident and how it all plays into effect?

      If you have collision insurance, which it sounds like you do, fault doesn’t matter. Your insurance doesn’t care – you pay a deductible and they fix your car

      The other insurance company is saying their driver isn’t at fault

      Your insurer will subrogate against the other carrier
