Body shop trying to give me back car with bent frame

Hi, I got in an accident and bent the frame of my car it is obvious the way the car is leaning. The body shop only fixed the tail light in the back and painted the bumper and is trying to return it to me. Is this legal? Should I call a lawyer? My insurance company?

I was given a supplement from my insurance company do you think they said it wasnt bent and didnt apply for the supplement because they wouldn’t make any money? Please help
