I recently got into a car crash and the insurance said it wasn't my fault, I have liability but the other person doesn't have insurance at all. The other driver ran a red and I ended up hitting them totaling my car. They didn't even have a license but they got away Scott free.

    I live in Oklahoma if that effects anything.

    What do I do from here?

    1. You sue the other driver

      “No insurance” doesn’t mean “get away with any damage you do”

      It means you have to handle potential claims against you out of your own money

      Get an estimate and if it’s cheap enough, it may even be small claims court level

    2. Assuming you do not have uninsured coverage on your vehicle, then your only option is to pursue them directly. However, usually people that do not have insurance or a license do not have money for you to get from them if you get a judgment, so if you do that, do it at your own risk.

      beyond the potential lawsuit, make sure you follow ok’s collision report requirements and consider notifying the police of the accident, just to make sure you’ve done everything in your power to try to get this uninsured unlicensed driver off the road

    4. In my state (not Oklahoma), if the police were involved at the collision scene, and they charged the other party criminally for driving/wrecking without a license and insurance, one of the stipulations of the court proceedings against them would be that the victim (you) would have to be made financially whole for the damage by the offending party.
