So i bought a truck from my parents about a month ago. they had me sign a contract as they were going to let me make paynents to them. my dad is listed as leinholder.

    My dad told me they would continue covering the truck on their insurance but it would be dropped by June 1st (so by end of month) this was to give me time to find insurance and get it in my name. which i did and policy was to start on May 30th to ensure no lapse.

    On May 28th I was driving and the truck caught fire in the engine. my dad was ckncerned about insudance raising rates if a claim was filed so i said well dont call insurance until we research mode about whether a fure would increase rates.

    Well he called insurance anyway and they sent someone out to look at the truck and he said they were considering it totaled. they are having me fill out a fire affidavit and thats where we are at now.

    I use the truck for work as a landscaper and am losing customers almost daily as i havent been able to work. its going on a couple weeks now and i just found out the policy also has rental covdrage of up to $1200.

    Im wanting to get a rental so i can continue working and then once insurance pays out my dad would get the rest of whats owed and I feel I should be able to get the remainder to hopefully gef a new truck if possible.

    However my dad is refusing go let me use the rental coverage and i am not sure if hes not claiming or possibly wabting to claim and keep any money for himself as he claims its his policy. i would think it is more likely he is just worried about rate increases but ive told him im oretty certain once he made insurance aware that any control of whether rates are increased are out of his control regardless to whether he accepts payment or rental coverage use.

    I am correct in assuming this to be the case? Does he have any ground to stand on as far as justifying not using the rental and bot accepting a payout, and if he does accept payout does he have a right to keep all money?
