I was in a car wreck on Sunday where a guy completely blew through a stop sign (I had no stop sign). It appears on the police report he is claiming he came to a complete stop so it’s looking like a he said she said. However there was a witness and I did obtain a copy of the police report and witness statement stating that he ran the stop sign. What are the odds that his adjuster (sun coast insurance) will change their decision?

    1. Go through your own carrier and they will attempt to get your deductible back in arbitration.

      Did you provide the witness statement to the other driver’s adjuster?

      What did the adjuster say about it?

    3. Shoot back with the witness statement. If all else fails, use your insurance coverage.

      Assuming it’s still operable, you can always wait a couple months to complete repairs and pay your deductible as long as you’ve filed the claim itself early on (full discretion: adjusters won’t like this advice on waiting to complete repairs because it screws up their reports, but not your problem).

      Your insurance will likely state you’re not liable, and will also attempt to recover your deductible through subrogation/arbitration. No guarantee of course.
