im a spouse who no longer lives in the home since may. when or who do i contact to get partial BAH. As well as what are the benefits that pertain to me? this is all new to me so i don’t know where to start. we have on base housing but will be turning it in this month. he has not provided or paid anything for me or step child since may. AD member hasn’t submitted any papers for a divorce so i’m just wondering as to why that might be.

      You can also reach out to the Key Spouse/Ombudsman for support.

      BAH is never paid to the spouse.

      File for divorce. Listen to your lawyer (and no one else).

      Decide if you’re going to stay in that area or move somewhere else.

      If it’s a legal separation, depending on branch of service, the commander can order the service member to see legal and figure out what portion of BAH they’re supposed to provide, but I don’t think they can enforce it, neither can they order to provide backpay. You maintain your health benefits up until divorce is finalized, same goes for the kid if they are in DEERS.

      Best is to see a lawyer and file for divorce, or if you haven’t been married too long and it’s an uncontested divorce you can go to your county’s court and file yourself.
