I was going straight at a green and a car in the opposite direction made an inappropriate left turn. The car to my left hit the brakes actually obstructing my view and by the time I saw the car and hit the brakes it was too late. Police report said other driver was at fault. I have a dashcam video showing whole event. They originally told me they will take complete liability and had some issues in their system with getting me a rental and they would call back. They never did. Spoke to someone else and they said they are now only taking 80% because im 20% at fault for not taking enough evasive action even though this is physically impossible and I could have hit poles swerving right and a car swerving left.

    Is there any way I can fight this? Now they dont want to give me a rental and want me to go through my insurance which I dont want to do.

      They don’t owe you anything at this point so there’s nothing you can do to make them change their mind. Your only option is to file a claim with your insurance and let them fight it out with them. They may decide to take it to arbitration where it might be ruled at 100% on them or some fault with you. No way to predict.

      If the person to your left was able to stop in time to avoid being in an accident, but you couldn’t, it sounds like you weren’t maintaining a proper lookout. The stopped car blocked your field of vision, but you should have noticed a car next to you stopping first.

      Hello, I was hit by a car who blew red light. I didn’t had collision coverage so GEICO raised their hands and said we cant do anything about this since I don’t have Collison coverage.

      I was accused of “not taking evasive action” and told that I am 25% liable for accident.

      I had dash cam video of the accident. I spoke to an attorney and sought his advice, Attorney told me that all insurance companies have great lawyers and you may not win this fight in small claims court.

      So I did what I do best, As a Professor of Physics I reconstructed the entire accident and scientifically proved that all decision’s taken by me were right. I was issued 100% refund.

      It was a tough fight, I had to use public transit and my life went upside down. But I knew I was right and was willing to fight for every inch.

      Lessons learned:
      1) The job of the first claim adjuster is to beat you down and make you lower the value of claim. Don’t given in.
      2) My insurance rate went up even though I was at no fault accident
