So, about three weeks ago, I was dropping my girlfriend off in front of a store and someone backed into my side panel. I called and filed a claim with their insurance and tried with mine, but they close at 5 PM and it was Friday, and they don’t open until Monday, so I had to do it on the app.

    On Tuesday, my adjuster texted me with two options… 1 – recommended for me to file a claim with their insurance and send them claim info. If they accept liability, I should file through the other insurance company without paying anything out of pocket, choosing any shop and closing the claim with mine. Option 2 was to file with mine, but I’m responsible for my deductible… then after repairs are done, we would go through subrogation attempting to recover all funds paid out under my policy.

    Obviously option 1… On Thursday, the other insurance adjuster called me accepting full liability but they have policy limit issues and suggested I file with mine – “Teslas are considered luxury vehicles and they’re not sure if the repairs could go past the coverage especially when they strip the car and could find more damage than the estimate.”

    The next day, my adjuster texted me saying since they have policy issues, I should go find a shop and get an estimate. Once approved, appraisers will send payment to the shop. Also, for the other insurance info so they can get in writing they have policy limit issues and deductible can be waived.

    I’m about to drop my car off next week for repairs and still not sure about the waived deductible. Is this considered like extenuating circumstances or something? I was totally bummed out I had to cough up 1k and possibly not get it back, but will it be 100% waived?"
