My wife [25] and I [24] were involved in a car accident two years ago. At fault driver knowingly drove with seizures, had one, sped his car to 100MPH+ and hit us and three other vehicles leaving nine people injured. We rolled hundreds of feet and somehow lived. We’ve been waiting since the accident for the settlement and now it is wrapping up. He had state minimums (25/50) and that does not spread well across nine people, even with minimal injuries. My wife was stabbed in the leg, I broke my thumb. I have mild – moderate back pain daily, but I manage it. Our bills were about $15,000 between the two of us and his insurance company is offering us $18,500. I only paid about $1000 of the bills, the rest were negotiated down significantly and she has about $3,000 outstanding that I’ll attempt to negotiate more. we are basically making a decent amount of extra cash from this crash. We do not have an attorney and do not care to or plan to hire one. I am wondering if it would be worth claiming underinsured motorist with my insurance to get more money, even though we’d have ~$15,000 of practically free money as it is?? We’re kind of in the boat of just taking the money and being done. But I wanted to get some advice first.

    1. Negligent driver with negligent limits. I’m only assuming you guys weren’t negligent and have great limits on your own policies? Which simply means you NEED to file a claim on your own policy as that’s persons limits will not be enough to take care of everyone involved.

    2. Absolutely youll want to use your own coverage for the property damage, if you haven’t already and for the medical UIM coverage to address your injuries.

      I’m confused you claim that you’re getting about $15,000 in what you call free money. But you also claim to have ongoing back pain from the accident that you’re going to have to manage.

      If you have ongoing back pain from the accident and you’re gonna need treatment for it like physical therapy or other services, I would file with your uninsured motorist bodily injury. 

      If you don’t have injuries that you think are going to need long-term management, then there’s nothing that you need to be compensated for. You shouldn’t be trying to profit from your Car Accident.
