I was in a not at fault car accident in 2023. The police took a report and explained in the report that a car backed into my car (it was totalled) and my car tapped the car in front of me on the highway. I went to the ER immediately after, as my car was totaled and I was pregnant at the time (baby is now healthy!). I also had a stress test for my baby that night and a couple of days after because of the accident and timing of my pregnancy.

Sample of report: “Unit 1, operated by x, rear ended (my car) operated by (me), who was forced with the impact to strike unit 3 operated by y. X stated that he had dosed off at the wheel due to fatigue and when he became alert he realized that unit 2 was right in front of him and was unable to make evasive maneuvers therefore impacting the rear of unit 2 commencing the string of events…”

Unfortunately, the other driver did not have insurance. I have a rider, so my insurance will kick in if a driver doesn’t have insurance. My medical insurance will also cover bills. However, there is a clause that I need to pay them back. I added up how much the insurance paid and made sure that the payout equals about what the insurance paid, so I can pay the insurance back. I have been receiving subrogation letters from the insurance. I have been trying to call them back since December. I’m not sure what to do because no one is calling be back or has an email. Will I get in trouble if it takes a while to pay them back? How do I discuss paying the insurance back if I can’t reach a rep?
