Rear ended while stopped in the shoulders for rain with spouse severely injured, hospitalized for over 10 days due to nerve injuries, internal bleeding and PE. Expecting 250k of bills. The other party at fault has only 30k and my UMBI covers another 70k. I have health insurance (10k Out of pocket Max) which I have used with the hospitalization but not sure if they would cover accident injuries. Hiring a lawyer would cost another 30-40%, with already no room to even completely cover hospitalization expenses and “pain and suffering”. Am I doomed? What other options do I have?
Doomed with medical expenses while not at fault. Am I helpless?

Health insurance will pay for the care but will ask you for reimbursement from the settlement. You can however negotiate with them and depending on the state you may be more successful than others states with this.
Otherwise you can hope they have assets but most people don’t, and to get the $30k it will require a release.
