I was told I have until August 17th to vacate the barracks and find a place to live. After calling complexes all over town, the only readily available unit doesn't have the SCRA in the lease terms. Not sure what I should do at this point. I was told from the military housing office that I shouldn't sign a lease unless the the SCRA was in writing. Is this something I could ask the apartment owners to amend for me? Does it have to be in writing for the clause to still be applicable? I'm honestly not even sure what will happen if I can't find a place to live in time, this seems like my only shot.

    Moving out of the barracks, only available apartment in town doesn't have the SCRA in the lease terms. What should I do?

      You should be fine. Sounds like from this you specifically have to sign them away. As long as there’s no “you here by are signing your SCRA rights away” you should be fine https://www.militaryonesource.mil/financial-legal/personal-finance/servicemembers-civil-relief-act/#:~:text=It%20is%20possible%20to%20waive,of%20military%20service%20are%20effective.

      However if you want the crystal clear. Bring it to your nearest legal office. They should be able to look it over. Ik for the Navy that’s a thing.

      Yes, it’s not up to the apartment company. They have no choice butnto let you out of the lease if necessary due to military orders. But, they also have horrible practices where they penalize the tenant by charging for additional days/months of occupancy or until the place is rented out again.

      The last place I was in tried their best to use that condition, as well as charge for any thing they could to not release the deposit. Housing was scarce so the unit got occupied the next month, but they wanted to try and squeeze any funds they can.
