Edit: seems like the only thing to do is to file a claim with my own insurance or just wait it out. My first time having to deal with this stuff so I appreciate all the responses!

    I was hit by a Tesla back in July (in Nevada), who ran. I caught the accident on my dash cam, but it didn’t get the plate #. Filed a police report. I found the Tesla at their apartment complex (dash cam caught them turning in there) and took photos of their damage and plate.

    I called Tesla and filed a claim against the driver but they have not responded to Tesla in almost 3 weeks. Tesla says they cannot claim liability without talking to their insured first even with all of the evidence.

    Is there anything I can do at this point or am I just in a waiting game for Tesla to contact the driver? I have prepared a claim with my insurance but they aren’t going to file it unless Tesla denies liability because I do not want a claim against my driving history unless absolutely necessary. I’ve never had a ticket/claim against me/my insurance so I don’t want to risk higher premiums if I can avoid it.

    1. If you don’t want to wait, file with your collision and have your car fixed and let your insurance company handle it. That’s what we pay them to do.

    2. Tesla insurance doesn’t owe you anything right now. But they have an obligation to their insured to do a thorough investigation to determine if their client is liable and if there’s coverage available. That means they have to talk to their insured. If they can’t, they will deny your claim. Even if they do talk to their insured they may very well still deny your claim. Your best bet is to file on your insurance.

      You file a claim and use your collision coverage, sue the driver, or wait for the other carrier to finalize liability.

    4. The other driver’s insurance company has no obligation to you, just to their insured.

      They aren’t going to pay without talking to their insured. And they can deny coverage to their insured and you if their insured doesn’t cooperate.

      Waiting is futile. Delay is the deadliest form of denial.

      If you haven’t seen the necessity after 3 weeks I don’t know what to tell you.

      You were involved in a collision so it is already on your driving record.

      Either wait to file a claim with your insurance. you’re only two options.

      Most professional and personal opinion’s are to file first party anyways. Idk what you mean by prepared. If you did a reporting only that still is technically on your record.
