MLA/ SCRA Amex Benefits

Hi,

My spouse is active duty military and we just got married. A few questions about the Amex fee waive process. I don't have a previous Amex card and so I believe that I am eligible MLA/SCRA according to a credit card agent who told me eligibility was based on: if I had the card before he enlisted (no) and or if I opened the card after marriage (yes). Based on the latter I am eligible. I was wondering if I should get the green card with this offer and then upgrade later to the gold? and then platinum? would the points transfer over? Would the fee waive still apply in this scenario?
