Hello,

    a few months ago my gf received a claim for an accident she wasn’t a part of in a city she wasn’t in. The insurance said they would handle it after she sent all the necessary info about her car. Today she received a call from a firm telling her to pay for the accident that again she was never even a part of. We also coincidentally have a video of her car pulling into her sisters house in a different part of the state around the same time the accident happened proving it would be impossible to be 2 hours away. How should she proceed? Her insurance doesn’t seem helpful in this process. I think she could get a lawyer if they keep trying to get her to pay since this seems like possible insurance fraud? but i feel like her insurance should be handling this more. the insurance also told her they only got like a partial plate or something as it was a hit and run so I don’t understand why it’s on her again she was in a completely different city

      If her insurance company has been notified and there is a claim number, they will most likely just tell them to go away since it wasn’t her. that being said, I don’t really see a need for a lawyer if you have sufficient video evidence that she wasn’t there. just tell them that and if they push, provide the video footage. 

      they probably just got a name from the partial plate and are trying to get some money but if she didn’t do it and wasnt there, she shouldn’t be on the hook.

    2. Lots of missing info here. What ‘firm’ wants her to pay? Do they want her or her insurance to pay? What does her insurance claims adjuster say?

      I’d ask for the documentation they have supporting their theory that it was your GF’s car and/or your GF was involved in the accident.

      Chances are, there may have been injuries and a demand was sent to her insurance for damages and they denied it so the law firm is trying to go after her personally. Unless they have proof that it was your girlfriend’s car, nothing will come of it. They might just need a formal letter stating that it wont be covered as she was not involved in the accident.

    5. She can write a letter (on paper, sent by mail) advising the caller that they have the wrong person and that they should stop calling her. She should keep a copy of the letter.
