I (California driver) got rear ended yesterday. It wasn't too bad. The person admitted fault and initially asked to pay out of pocket. Damage is about $1,000. She decided this morning that she wants to go through insurance instead and asked for my license this morning, that's when I realized it expired last month. I haven't responded yet. Will the other driver's insurance company report that my license was expired and will I face any consequences?

The other person’s insurance company does not care about your license status.
You don’t need to communicate with her anymore if she has filed with her insurance. She should send you the policy and claim number and that’s it.
She doesn’t need your DL# to report to her insurer, so just provide your basic name, address, phone & email info. No need to share your DOB or DL.
Your DL being expired is a criminal matter (not that you’re a criminal; it’s just legalese when determining what matters to insurance vs what matters to police and the DMV). The only thing the insurance company cares about is what happened to cause the accident and who caused it.
Worst case you’ll get a payable ticket for the expired license. Go get it taken care of ASAP and if you even were to get a ticket (if this individual reports you) you could fight it in court and show you got your license active again.
You give: Name, phone number, email, mailing address
You ask for: claim number, assigned adjuster’s phone number
The thing I would be concerned about is that if she flipped to insurance she might have changed her story and may end up trying to screw you over . License status doesn’t matter

Ask her for her insurance info and give her yours. Talk ONLY to your company. Let them talk to her company. Don’t say anything about the accident except to your insurance company or your lawyer. BTDT

Thanks, everybody! I just renewed my DL online and got a digital copy. It was actually only expired by 3 weeks so hoping it won’t cause any issue. She already had my registration so I just sent her my contact info.
You don’t need to send her your drivers license. Just renew it and be on your way. You could send her your name, phone number, that’s about it.
My son went 4 months with an expired license, and if possible, renew online. As said, the insurance company will not care about the expiration (at least here in Massachusetts).
You provide your name and insurance information…exactly as your insurance company probably wrote you down as a reminder on the back of the insurance card. No need to share other information or your DL status.
That said, you screwed up and shouldn’t have let it lapse. It may have ramifications for this incident, but certainly renew immediately.
