I got hit today by someone who ran a stop sign and went on to claim they didn’t when we filed the police report. They hit me hard enough to do decent damage to my wheel (enough that I couldn’t drive it home), so I’m wondering if that fact will be enough to determine their speed upon impact, therefore proving that they ran the stop sign.

    I haven’t been in an accident like this before so I’m not familiar with how all that works, but I figured this was a good place to ask.

    1. The other driver will lie to their insurance company. Their insurance company will believe them unless there is evidence to the contrary. They won’t do some huge investigation they will just deny being at fault and tell you to pound sand. 

      So you will file with your insurance and get your car repaired and pay your deductible. If your insurance company is able to get paid by the other insurance company (they may work on this behind the scenes) you could be reimbursed for the deductible you paid. 

    2. Unless there is a witness, dash cam footage or someone recording it will usually be word vs word.
