    Our Landlord knew back in Mayish that our front porch needed to be replace. They promised to come back after May when inspections were done.

    End of August the porch finally gave way, just a segment of it but enough for me to end up falling through and hurting myself (being disabled as I already am, it sucks). It was right by the door too, even our dogs almost fell through.

    They finally replaced it today after we reported it and mentioned I had hurt myself.

    So question is, should I report this to my renters insurance?

    I have renter's insurance and hurt myself when part of our porch caved in, should I report it to the insurance? When *should* I report an injury?

    1. Your renters insurance is for your liability and personal property. You will want to file on your landlord’s rental policy – ask for the insurance company and policy number, or for them to file that claim.

    2. You wouldn’t report this to your renters insurance, as your renters insurance wouldn’t be covering the damage to the porch. You should file a claim with your landlord’s liability insurance for medical expenses and cost of medical, as well as time lost. If you were not seriously injured, you should probably get a little money for pain & suffering in addition to medical costs. If you were moderately or seriously injured, you may want to find an attorney but beware that they will take a sizeable chunk of any funds (which includes medical expenses) which may put you in the negative.

    3. Renters insurance typically just covers your contents of the home… not the home itself not injuries on it. You could file on the home owners insurance though.

    4. File a claim on your landlords policy. They are liable. Your renters policy is not for this scenario.

      NAL but unless you contributed to the collapse of the deck, this is entirely on the landlord. The landlord may pull something from your rental agreement about not being liable, but since they knew about it in May and took 4 months to remedy voids that.

      I suggest you write a letter to the landlord describing from May to present on what happened. Mention your injuries and copies of any medical bills can be made available if requested. Put a respond by date and send it cert/return receipt so you know they got it.

      If they or their insurance don’t respond or tell you to blow, then lawyer up…fast.
