We recently borrowed a truck from a family member to move some stuff. After moving we went to the car wash. The attendant indicated to us to back up and come to another lane. There was a car behind us that wasn’t at all visable to us or the attendant (who came up and apologized to us both) and the ball of the hitch knocked their bumper pretty good. No issue with fault, it was our fault, but our insurance says they cover us as the driver but not the car that was hit because our families car hit the other car, the family insurer says they won’t pay because family member wasn’t driving the car. We’re in Ohio and I believe according to Ohio law our insurance should pay? I know that’s not the case in most places though. My husband is panicking because he thinks this guy is going to sue us (although that has not been mentioned and the guy has been very nice so far).

    1. Not familiar with Ohio law or an insurance specialist but it is my personal experience that they will absolutely deny straight up to see if you’ll put up a fight. You should take a good look at your policy though. Going thru a massive claim right now (homeowners) and have been told no it’s not covered nearly every step of the way until we argued back and forth. All of what we’ve argued no on has been covered btw.

    2. Ask for the denial in writing– it should quote the policy language. Take that denial to your insurance company and they should then handle the claim.

      The policy follows the vehicle, not the person. Your insurance policy would not come into play as that would be considered secondary. The vehicle policy is primary and a claim for the property damage would have to be filed on the vehicles policy. The loss would be covered if you had permissive use to drive the vehicle which i believe you had
