    I saw a question similar to this posted a few months ago but it was a little different than our situation. We’ve been on the waiting list since June and just got the info that we have a house ready in late October (yay!). The lease we’re in right now is crumbling us financially so we feel it is best to take the base housing. (Before anyone comments it was something out of our control as far as the financial part and although we should have planned better we didn’t and it is what it is now we accept our fault in that). Our lease has a military clause and we’re a little confused on whether or not they’ll let us out of our lease or not(clause included below). Thank you in advance!

    MILITARY CLAUSE: In the event TENANT is or hereafter becomes, a member of the United States Armed Forces on extended active duty and hereafter the Tenant receives permanent change of station (PCS) orders to depart from the area where the Premises are located, is deployed, or is relieved from active duty, retires or separates from the military, or is ordered into military housing, then in any of these events, the Tenant may terminate this lease upon giving thirty (30) days written notice to the Landlord. The Tenant shall also provide to the Landlord a copy of the official orders, or a letter signed by the Tenants' commanding officer, reflecting the change which warrants termination under this clause. The Tenant will pay prorated rent for any days which he/she occupies the dwelling past the beginning of the rental period. The damage/security deposit will be promptly returned to the Tenant, provided there are no damages to the Premises as described by law.

    1. Talk to your legal assistance office. It doesn’t sound like you’re being ordered to Military Housing, so your military clause won’t help you nor will SCRA.

    2. Sounds like your CC can easily do this for you – especially if it’s impacting your financial readiness. Check with legal but I’d absolutely sign anything I could to help you out.
