Hello everyone,

    My contractor caused a collapsed floor in my property that destroyed a lot of my personal items/materials and structural damage.

    I filed a claim with my insurance and his companies. Here’s where it gets tricky, my insurance says I should cancel the claim with them and just use my contractors because then I don’t lose out on my deductible (5k deductible). If I do go through my own insurance they said they will most likely go through subrogation and have his insurance pay and I will likely get that deductible back though. My insurance sent out an adjuster and engineer and they concluded it was the contractors fault for the collapse.

    His insurance says I should go with my own insurance as it’s for replacement cost and the companies is only for actual cash value. I also will be able to start working and fixing the property immediately instead of waiting longer.

    Which one should I end up going with at the end of the day? I can’t tell which one is better and if they’re being honest with me or just trying to get me to file with the other.
